Pilialoha Dating Services LLC is sometimes referred to as “PDS,” and the Client, Member, or Participant is sometimes referred to as “Client” or “CMP” or “CMPs”.
This Privacy Policy helps CMP understand how PDS collects, uses, stores, and manages the personal information that you provide when using the PDS Website and any other applications, tools or other related services offered by PDS. By using the Services, CMP agrees to the collection and use of their information as outlined in this Privacy Policy. PDS reserves the right to change the Privacy Policy at any time. These changes become effective immediately upon posting on the Website. Each time you use the Website, CMP agrees to review the current Privacy Policy. CMP can determine when the Privacy Policy was last revised by referring to the "Effective Date" at the top of this Privacy Policy. Any modified Privacy Policy becomes effective upon publication.
By continuing to access and use the PDS Website and participate in any Services after the effective date of any changes, CMP agrees to be bound by the modified terms.
1. How Information Is Used
PDS collects the information required to provide CMP with the Services. When you register or purchase a service on the Website, or create an account, PDS collects the information you enter and submit—such as your name, phone number, and email address, etc.—to identify you. As part of your profile completion, PDS will also collect photos and other distinguishing profile information. Authorized employees and contractors may be permitted to access your personal information, but this is only to provide you the Services. PDS will not disclose your personal information, photos, or identifying information to any other CMP without your consent, nor will PDS disclose their information to you.
2. Rights
PDS does not sell or share personal information. PDS also does not use or disclose Sensitive Personal Information. CMP has the right to access personal information and to request removal of personal information, subject to exceptions. CMP has the right to correct inaccurate information, the right to limit the use and disclosure of sensitive personal information, where applicable, the right to opt out, and the right not to be discriminated against for exercising privacy rights..
3. Situations That May Lead to Disclosure of Information
In certain situations PDS may need to disclose information:
in response to a subpoena, court order, investigative demand, or request for cooperation by law enforcement, legal authorities, or government agencies;
to enforce our Service Agreement and Terms & Conditions or other policies;
to defend ourselves against legal claims, or exercise our legal rights;
to prevent, investigate, or take action against illegal activity, fraud, suspected fraud, or violation of the Service Agreement and Terms & Conditions;
to defend our employees, our company, our safety, or our users;
to comply with legal data retention obligations, including without limitation tax and accounting legal requirements and documents evidencing our compliance with applicable law;
to support our customer care decisions, enforce our rights, and enable us to defend ourselves in the event of a claim, in anticipation of potential litigation, and for the establishment, exercise, or defense of legal claims;
to prevent users who were banned or people who were found to be under the age of 21 from opening a new account;
in connection with the sale of our business, a merger, acquisition, consolidation, proprietary information sale, asset sale, or large corporate transaction; or
in the event Pilialoha Dating Services LLC files for bankruptcy.
4. Data Retention
PDS will retain the personal information received as described in this Privacy Policy for as long as CMP uses PDS Services or as necessary to fulfill the purpose(s) for which it was collected, to provide the services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce PDS agreements, and comply with applicable laws. Your consent to such purposes remains valid after your relationship with PDS terminates.
5. How is Information Protected
PDS generally protects the information CMP submits, both during transmission and after receipt. However, no method of electronic transmission or storage is 100% secure. Therefore, even though efforts are made to secure information, PDS cannot guarantee or promise that CMP communications or personal information will always remain safe and secure. Therefore, CMP should take special care in deciding what information to send via email or other electronic means.
You are responsible for all uses of the PDS Services.CMP is responsible for maintaining the confidentiality of their own email, phone, device, passwords, accounts, and communications.
To the extent permitted by the law, PDS disclaims liability for any theft, loss, or interception of or any unauthorized access or damage to any data or communications. By using PDS Services, CMP acknowledges that they understand and agree to assume these risks.
6. Sensitive Information
CMP may provide PDS with information that is considered "sensitive" under applicable law, including but not limited to religious beliefs, sexual orientation, ethnicity, and political views. The information provided is used to provide the Services to you. By providing this information, CMP agrees that PDS may store, process, and use such data to provide the Services. CMP may change, delete, or update their information at any time.

Geolocation information, generally approximate location based information you provide.
Audio, electronic, visual, or similar information, such as calls, Zoom meetings, photographs, or videos.
Professional or employment-related information.

Inferences drawn from personal information, such as preferences, compatibility factors, personality traits, history, background, relationship experiences, and relationship goals.
Sensitive personal information, where voluntarily provided or reasonably necessary for services.
